General Terms and Conditions between Festival Cadeaukaart and Partners

The following general terms and conditions apply to all agreements between Festival Cadeaukaart and Partners.

These general terms and conditions, including future amendments, apply to existing and new agreements. Amendments take effect immediately upon publication on the Festival Cadeaukaart website (festivalcadeau.com). A paper copy will be provided free of charge upon request.



Article 1: Definitions

In these general terms and conditions for Partners, the terms written with a capital letter have the following meaning:

FestivalcadeauTicketGift B.V., also trading under the name Festivalcadeau, is a private limited company established under Dutch law, with its registered office at Favaugeplein 21, Zandvoort, and registered in the Trade Register of the Chamber of Commerce under number 76673774. For the issuance and processing of the Gift Card, Festivalcadeau uses the technical infrastructure of Intersolve B.V. Festivalcadeau guarantees careful management of the funds paid by holders, which are held in a separate account and used to fulfil obligations related to the issuance, management and execution of its Gift Card(s).

Partner(s): The counterparty, such as a festival organiser, ticketing provider, PSP, affiliate, sales partner or website operator, who professionally commits to Festival Cadeaukaart by integrating, accepting or making the payment method visible within its platform, website or communication channels.

Connection Costs: The one-off costs owed by the Partner to Festival Cadeaukaart for the administrative processing of the connection.

Payment: The payment made by a Holder with the Gift Card, which is processed by Festival Cadeaukaart and paid out to the Partner.

Gift Card: The physical and/or digital payment instrument issued to a Holder, with which payments can be made at affiliated Partners.

Participation Agreement: The agreement between Festival Cadeaukaart and Partner, and – where applicable – between Intersolve and Partner, to which these terms and any Acceptance Conditions apply.

Participation Programme: The programme whereby Festival Cadeaukaart issues gift cards under its brand and promotes them through various channels.

Account: The bank account specified by the Partner on which the payouts of redeemed gift card balances are deposited.

Terms of Use: The terms and conditions applicable to the use of the Gift Card by Holders and published on festivalcadeau.com.

Holder: Any natural or legal person who possesses a Gift Card and uses it as a means of payment.

IP Rights: All intellectual property rights, such as copyright, trademark, design, patent and trade name rights.

Brand: The registered trademark 'Festival Cadeaukaart', owned by TicketGift B.V. or its licensor, as registered with the Benelux Office for Intellectual Property.

Multiple Purpose Voucher: A Gift Card with a value that can be spent on multiple products with different VAT rates or domestically and abroad.

Recipient: The party receiving confidential information within the framework of the agreement.

Payment Service Provider (PSP): A party that, in the case of distribution, provides a technical link between Intersolve and the Partner to enable payments from Holders.

Commission Costs: The costs owed by the Partner to Festival Cadeaukaart for participation in the Participation Programme.

Balance: The remaining credit on a Gift Card, reduced by previous payments by the Holder.

Payout: The payment that Festival Cadeaukaart periodically makes to the Partner for accepted payments with the Gift Card.

Provider: The person or entity who purchases a Gift Card and receives a unique code.

Redeemer: The natural or legal person who redeems a Gift Card code for products or services of an affiliated Partner.
